How and when do I get paid?

The Affiliate will receive 30% on sales generated from their site on the following JD Products:
=> All BodhiGold - Data Packages or data combination from the Product List (excluding some Exchanges*).
=> All Bodhi History sales.
=> All Ezy Software sales - EzyChart; EzyManager; EzyAnalyser; EzyProfessional &
      EzyStation.
=> GTE Charting sales.
=> ScanVest sales.

Note: Commission is not paid on third party products. These include: JD Insider, Books, Hull Newsletter, Home Study Courses, Stator, PocketPC, Excelerate, Insight Trader charting software and some *BodhiGold Exchange Data (EDI).

Sales generated from the Affiliate website will be collated at the end of each month and the amount will be paid direct to the clients nominated account by the 15th of the month. All commissions are paid in Australian Dollars.

TERMS AND CONDITIONS

Definitions:
In this Agreement ‘JD’ refers to JustData. ‘Affiliater’ refers to you the applicant. ‘Site’ refers to either the JD or Affiliate Website, unless otherwise stated. ‘Product’ refers to software and data produced by JD.
JD reserves the right to amend this agreement from time to time, at its sole discretion. Amendments will be effective only after being put in writing and agreed to by JD and the Affiliate.

Applicant Acceptance:
Your Affiliate application will be processed upon receipt and JD will notify you via email, of your acceptance. If JD believe your Website or business activities are not suitable for any reason whatsoever for promotion of the JD products then JD reserves the right to reject your Affiliate application.

Unsuitable web sites where JD products cannot be promoted or advertised:
• promotes sexually explicit materials
• promote violence
• promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age
• promote illegal activities
• promote gambling

This Agreement commences on the date JD accepts your application and will run continuously until terminated.

General Provisions:

• This Agreement is the only agreement between JD and the Affiliate and supersedes any other arrangements or agreements, written or verbal.
• JD and the Affiliate are completely separate entities.
• The Affiliate has no proprietorial rights or obligations to any of JD's products.
• The Affiliate will not use any business name or trademark used or registered by JD in any way other than in the direct promotion of JD products.
• The Affiliate agrees to indemnify JD against any demands or damages JD may sustain as a result of any misleading conduct or statements made by the Affiliate, it's officers or employees concerning JD products.
• All JD products must only be produced and provided by JD.

Refunds:
In the rare case where a sale generated from your site ends with the sale being refunded and the 30% has already been paid to you, it will be deducted off the next months payment.

Termination:
Either party may terminate this agreement by giving notice in writing.

This Agreement is governed by the laws of the State of Queensland, in the Commonwealth of Australia.
